Why Attorney-Led Timeshare Cancellation Is Better

Many timeshare exit companies claim that you don’t need a lawyer to help you cancel a timeshare.

While this is technically true (in the same way you don’t need a dentist to extract a tooth), having a lawyer involved in your timeshare case is just simply a better approach.

Attorneys can do things that traditional exit companies cannot: 

  • They can provide real legal opinions and dispense legal advice (with the appropriate engagement agreement in place).
  • They can compel your timeshare developer to come to the table and negotiate.
  • They cannot simply be ignored, which is a common tactic for some timeshare developers.

We’re glad you asked! First, let’s get one thing out of the way: Attorneys at Stonegate Law are not “appearance counsel,” which means they will not be showing up to appear in court for you (except in extremely rare cases).

Here are some common things our attorneys do related to timeshare cancellation:

  • Write letters to underwriters letting them know your timeshare purchase is being legally disputed.
  • Provide formal letters to your HR dept, if your credit was impacted and you require validation to maintain a security clearance 
  • Prepare pleadings and motions that you can file pro-se, should you need it.
  • Organize evidence to help with regulator complaints.
  • Oversee your legal exit strategy, prepare and/or sign off on escalated correspondence.
  • Other ad-hoc things that require an attorney.

Sub-Par Strategies From Other Timeshare Relief Companies

Each of these tactics (except outsourcing) may have a legitimate use, but if only used by themselves, it’s a recipe for disaster.

Regulator Complaints

This will work, but ONLY when there is a legitimate basis for the complaint. Companies that use this strategy are in danger of being legally attacked by resort developers.

Writing letters begging for a release from your timeshare is not effective. Some companies actually pretend to be YOU when doing this. This is because they know that resorts will not deal them directly.

The old “go-to” for many timeshare exit companies. This strategy is the reason that “credit protection” can sometimes enter the conversation about timeshare exit. It’s not a legal strategy.

Many companies in the timeshare relief space are simply sales organizations with no viable service of their own. You pay them thousands of dollars, then they pay a 3rd party around $750 or $1000 to perform a “service” which is often strategic default.

This is VERY common. Beware of outsourcing operations.
